Terms and Conditions

Please read these Terms carefully.
They form a binding agreement between you and Parqey AB. Parqey provides a marketplace for parking spaces; it does not own or operate the spaces listed by Hosts.
1. About these Terms
These Terms and Conditions (the “Terms”) govern your access to and use of Parqey’s websites, mobile applications and related services (together, the “Service”). The Service is operated by Parqey AB, company no. 559516-8575, Berghemsvägen 5, 133 37 Saltsjöbaden, Sweden (“Parqey,” “we,” “us” or “our”).
By creating an account, clicking to accept these Terms, making or accepting a booking, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
A “Host” is a user who lists a parking space. A “Driver” is a user who searches for, books or uses a parking space. “User” means a Host, Driver or both. A “Booking” is an agreement between a Host and Driver for use of a listed space during a specified period.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into contracts to use the Service. If you use the Service for a company or other organization, you represent that you are authorized to bind it.
You must provide accurate, current and complete information, keep it updated, safeguard your login credentials and promptly tell us about suspected unauthorized use. You are responsible for activity through your account unless caused by Parqey’s breach of duty. You may not transfer, sell or share an account without our written permission.
We may request identity, vehicle, ownership, payout, tax or other verification where reasonably necessary for safety, fraud prevention, payment processing or legal compliance. Verification does not amount to an endorsement, background check or guarantee.
3. Parqey’s role
Parqey provides a technology marketplace that helps Hosts and Drivers find each other, communicate, make Bookings and process payments. Except where expressly stated, Parqey does not own, lease, possess, control, manage, inspect, maintain, secure or insure parking spaces, vehicles or charging equipment.
The Host—not Parqey—provides the parking space. The Booking contract is directly between the Host and Driver. Parqey is not a real estate broker, property manager, parking operator, insurer or agent for either User, except that Parqey or its payment provider may act as the Host’s limited payment collection agent as described below.
We do not guarantee the identity or conduct of any User, or the legality, availability, condition, accessibility, security, suitability, quality or accuracy of any listing. Users must exercise reasonable care and make their own decisions.
4. Host terms
4.1 Authority and legal compliance
By listing a space, the Host represents and warrants throughout the listing and every Booking that the Host owns the space or has all permissions needed to offer it, and that doing so complies with applicable laws, permits, zoning rules, leases, mortgages, homeowners’ association or condominium rules, property rules, insurance terms and utility agreements.
The Host is responsible for any license, registration, parking occupancy tax, sales tax, permit, signage or other local requirement applicable to the space or the Host’s activity. Parqey may request evidence and may remove a listing if it reasonably believes the listing is unlawful or unsafe.
4.2 Accurate listings and availability
The Host must provide complete and accurate information about the location, size, vehicle restrictions, access, hours, price, amenities, accessibility, security features, EV charging and any material limitation. Photos must show the actual space. The Host must keep availability current, honor accepted Bookings and ensure the space is identifiable, accessible and available for the full Booking period.
Access codes, gates, locks and other entry systems must work as described. The Host must promptly inform the Driver and Parqey of any problem that may affect a Booking and take reasonable steps to minimize disruption.
4.3 Safety, property and EV charging
The Host must take reasonable steps to keep the space and access route in a condition suitable for the listed use, disclose known hazards and not expose a Driver to unreasonable risk. If EV charging is offered, the Host is responsible for ensuring the charger is lawfully installed, maintained, safe and permitted under applicable law and utility or property rules. The listing must clearly state any separate charging terms or restrictions, and all mandatory charges must be included in the displayed total price except government-imposed taxes that may lawfully be shown separately.
4.4 Host conduct and responsibility
The Host may not enter a Driver’s vehicle, use it, retain keys unless expressly agreed, discriminate unlawfully, surveil areas where a person has a reasonable expectation of privacy, or impose rules or charges not disclosed before Booking. The Host is responsible for its acts and omissions and for damage it causes.
5. Driver terms
The Driver must provide accurate Booking and vehicle information, use only the booked space, follow lawful and disclosed instructions, arrive and leave within the Booking period, and comply with parking, traffic, fire, safety and property rules.
The Driver must use a roadworthy, lawfully registered and insured vehicle where required by law. The Driver may not store unlawful, hazardous, flammable or perishable items; perform repairs except in an emergency; live or sleep in the vehicle; obstruct access; create a nuisance; use the space for commercial operations; or use charging equipment contrary to instructions.
The Driver is responsible for the vehicle, personal property and any injury, loss, contamination or damage caused by the Driver, the vehicle or accompanying persons. A Booking may not be transferred without the Host’s and Parqey’s consent.
6. Bookings, prices and fees
The listing and checkout flow will show the Booking period, Host price, mandatory service fees and other required charges. For California consumers, and wherever otherwise required, the first price displayed or advertised for a Booking will include all mandatory fees or charges other than government-imposed taxes that may lawfully be excluded. The total amount payable will be shown before confirmation.
A Booking becomes binding when the Service confirms it. Additional listing rules and the cancellation terms shown before confirmation form part of the Booking. If a displayed price or availability is clearly erroneous because of a technical or typographical error, we may cancel before use and issue a full refund.
Hosts set their prices subject to applicable law and Parqey’s platform rules. Users may not circumvent Parqey’s payment system, ask another User to pay off-platform, or use contact information obtained through the Service to avoid applicable fees for a transaction initiated through Parqey.
7. Payments, payouts and taxes
Payments and payouts are processed by third-party providers, including Stripe. Use of payment services may be subject to additional provider terms and identity, bank, tax and anti-fraud checks. Parqey does not store full payment card numbers.
The Host appoints Parqey and its payment provider as the Host’s limited payment collection agent solely to accept amounts due for Bookings. Payment by the Driver through the Service satisfies the Driver’s payment obligation to the Host for that amount, subject to chargebacks, reversals and refunds.
Host payouts are made according to the schedule and fee information shown in the Service. We may delay, withhold, offset or reverse a payout where reasonably necessary to address refunds, chargebacks, suspected fraud, sanctions, legal obligations, a negative balance or a breach of these Terms. We will act reasonably and provide notice where lawful and practicable.
Users are responsible for determining and meeting their tax obligations. Parqey may calculate, collect, withhold, remit or report taxes and User information where required by law, including information reporting to tax authorities. Hosts must provide accurate tax information on request. Parqey does not provide tax advice.
8. Cancellations, refunds and booking problems
The cancellation policy displayed before the Driver confirms a Booking applies to that Booking. It will state the applicable cancellation deadline and refund, if any. A Driver who arrives late or does not use the space is not entitled to an extension or refund except under the displayed policy or applicable law.
If a space is unavailable, inaccessible, materially different from the listing or unsafe, the Driver must, where practicable, not use it and contact Parqey promptly with reasonable evidence. We may help find another space, cancel the Booking and/or refund affected amounts. This does not limit mandatory consumer rights.
A Host may cancel only when reasonably necessary. Repeated or avoidable Host cancellations may lead to fees, withheld payouts, blocked dates, ranking changes, suspension or removal. Refunds are normally returned to the original payment method; processing times depend on the payment provider.
9. Overstaying, towing and enforcement
A Driver must leave by the end of the Booking or obtain an extension through the Service. Overstaying may result in additional charges, loss of access, towing or lawful enforcement. Neither these Terms nor a Booking independently grants a Host authority to tow a vehicle.
Hosts and Drivers must comply with all laws governing private-property towing, notice, signage, authorization, storage and fees. In California, this includes California Vehicle Code section 22658 and any local requirements. A Host must not arrange or authorize towing unless every legal condition is satisfied. Parqey does not direct towing and is not responsible for unlawful towing by a User or third party.
10. Incidents, damage and insurance
Users should promptly report accidents, injuries, property damage, suspected crime or safety incidents to the appropriate emergency service or authority and to Parqey. Users must preserve relevant evidence and cooperate reasonably with an investigation.
Parqey does not provide vehicle, property, liability or other insurance unless a specific protection program is expressly described in writing for a Booking. Users are responsible for determining whether their own insurance covers hosting or using a space. Any insurance or protection program has separate terms that control in case of conflict.
11. Reviews, messages and other User Content
“User Content” includes listings, photos, messages, reviews and other material submitted through the Service. You retain ownership of your User Content. You grant Parqey a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, display, distribute and use it as reasonably needed to operate, improve, secure and market the Service. This license ends when the content is deleted, except for lawful archival copies, content already shared with others, and material needed for legal or safety purposes.
You represent that you have all rights needed for your User Content and that it is accurate and lawful. You may post an honest review, including a negative review. You may not post fake, retaliatory, discriminatory, unlawfully threatening, defamatory, privacy-invasive, infringing or irrelevant content. We may moderate or remove content under these Terms but do not undertake to monitor all content.
12. Prohibited conduct
You may not:
· break the law, infringe another person’s rights, discriminate unlawfully, facilitate crime or create an unreasonable safety risk;
· misrepresent identity, authority, a vehicle, a parking space, availability, price, location, amenities or Booking circumstances;
· scrape, copy, reverse engineer, bypass access controls, introduce malware, overload or interfere with the Service except to the extent a restriction is prohibited by law;
· use bots or automated means to create accounts or Bookings, manipulate rankings, reviews, fees or availability, or test vulnerabilities without permission;
· harass another User, use personal information for an unrelated purpose, send spam or disclose access codes or non-public location details; or
· circumvent payments, refunds, safety controls, sanctions checks, account restrictions or enforcement measures.
13. Parqey intellectual property and app license
Parqey and its licensors own the Service, software, design, trademarks and content other than User Content. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Service for its intended purpose. No other rights are granted.
Feedback may be used without restriction or compensation, provided we do not publicly identify you without permission. If you believe content infringes your copyright or other rights, contact help@parqey.com with enough information for us to investigate.
14. Third-party services
The Service may rely on or link to payment processors, maps, navigation, identity verification, app stores, communications tools and other third-party services. Their terms and privacy practices may apply. Parqey is not responsible for a third party’s independent service, content or conduct, but this does not limit responsibility that cannot lawfully be excluded.
15. Communications
You agree to receive electronic notices and transactional communications relating to your account, security, Bookings, payments and the Service. Electronic notices satisfy legal writing requirements to the extent permitted by law. Marketing email or text messages will be sent only where permitted and, when required, with separate consent. You may opt out of marketing at any time, but may still receive necessary transactional messages. Standard carrier charges may apply.
16. Privacy
Our collection and use of personal information is described in our Privacy Policy and Cookie Policy. Users may use another User’s personal information only as necessary to complete a Booking, resolve an incident or comply with law, and must protect it from unauthorized use or disclosure.
17. Suspension, termination and account deletion
You may stop using the Service and request account deletion at any time, subject to completion of active Bookings and retention required by law. We may warn, restrict, suspend or terminate access, remove content or cancel Bookings if we reasonably believe this is necessary to protect Users or the Service, comply with law, address fraud or safety risk, or respond to a material or repeated breach. Where appropriate, we will give notice and an opportunity to respond.
Provisions that by their nature should survive termination—including payment obligations, licenses for retained content, disclaimers, liability limits, indemnities and dispute provisions—will survive.
18. Service availability and disclaimers
We aim to provide a reliable Service but do not guarantee uninterrupted, error-free or secure operation. The Service may be changed, suspended or unavailable because of maintenance, outages, third parties or events beyond reasonable control.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” PARQEY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ANY WARRANTY ARISING FROM COURSE OF DEALING. WE DO NOT WARRANT ANY USER, LISTING, SPACE, VEHICLE, ACCESS METHOD, EV CHARGER, BOOKING OUTCOME OR USER CONTENT. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARQEY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING FROM THE SERVICE, A BOOKING, A USER, A SPACE, A VEHICLE, THEFT, VANDALISM, TOWING, A FINE, PROPERTY DAMAGE, PERSONAL PROPERTY OR THIRD-PARTY SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARQEY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE SERVICE FEES PAID BY YOU TO PARQEY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100.
These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited, including where applicable liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, statutory consumer remedies, or violation of law. Your mandatory consumer rights remain unaffected.
20. Indemnification and User disputes
To the extent permitted by law, you will defend, indemnify and hold harmless Parqey and its directors, officers, employees, contractors and affiliates from third-party claims, losses, liabilities, damages, fines, penalties and reasonable legal costs arising from your breach of these Terms, your User Content, your space or vehicle, your acts or omissions, taxes for which you are responsible, or your violation of law or another person’s rights. This obligation does not apply to the extent a claim was caused by Parqey’s own breach, negligence or willful misconduct.
Users are responsible for resolving disputes with each other. We may facilitate communication or make a platform decision about payments, refunds or account access, but do not become a party to the underlying dispute and do not waive either User’s legal rights.
21. Governing law and disputes
Please contact help@parqey.com first so we can try to resolve a dispute informally. Either party may ask the other to participate in good-faith informal discussions for 30 days before filing a claim, unless urgent relief, a limitation period or applicable law requires otherwise.
If you reside in the United States, these Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Courts of competent jurisdiction in California will have jurisdiction, except that you may bring an eligible claim in small claims court and mandatory law may allow or require a different venue.
If you are a consumer in the EEA, United Kingdom or another jurisdiction with mandatory consumer protections, the law and courts designated by those protections apply. Otherwise, these Terms are governed by Swedish law and disputes are subject to Stockholm District Court as court of first instance. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
22. Apple App Store terms
If you downloaded the app from Apple’s App Store, the following additional terms apply:
· These Terms are between you and Parqey, not Apple. Parqey, not Apple, is responsible for the app and its content.
· Your license is non-transferable and limited to use on Apple-branded products you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable Usage Rules, including permitted Family Sharing, volume purchasing or Legacy Contact use.
· Parqey is solely responsible for maintenance and support; Apple has no obligation to provide them.
· If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund any purchase price paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation. Parqey is responsible for other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty.
· Parqey, not Apple, is responsible for product liability, legal or regulatory, consumer protection and intellectual-property claims relating to the app.
· You represent that you are not located in a country or region subject to a U.S. Government embargo or designated as supporting terrorism and are not on a U.S. Government prohibited or restricted party list.
· You must comply with applicable third-party terms when using the app.
· Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

23. Changes to these Terms
We may update these Terms to reflect changes to the Service, law, safety practices or business operations. We will post the revised Terms and update the effective date. If a change materially affects your rights, we will provide reasonable advance notice where required. Changes apply prospectively. If you do not agree, you must stop using the Service before they take effect. We will request renewed acceptance where required by law.
24. General
These Terms, the Privacy Policy, the cancellation terms shown for a Booking and any expressly incorporated policies are the entire agreement about the Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition or sale of assets, subject to applicable law. No partnership, joint venture, employment or general agency relationship is created. Headings are for convenience only.
